By creating an account or using SM Expense, you agree to these Terms of Service. Please read them carefully. If you do not agree, please do not use our service.

Section 01

Eligibility & Accounts

Age Requirement

You must be at least 13 years old to create an SM Expense account. Users between 13 and 17 must have a parent or legal guardian who has also registered an account and linked to theirs. By creating an account, you represent that you meet this age requirement.

Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep your information updated.

Parent-Student Linking

When a parent links to a student account, the student controls their own privacy settings and determines which expense categories are visible to the parent. Both parties consent to this data-sharing arrangement upon linking.

Use of Service

What SM Expense Is

SM Expense is a personal expense tracking and budgeting application. It helps users log expenses, set budgets, scan receipts with AI, and optionally share financial summaries with linked parent accounts.

What SM Expense Is NOT

SM Expense is not a bank, financial institution, or financial advisor. We do not hold, transfer, or manage money. We do not connect to bank accounts. We do not provide financial, tax, or investment advice. All financial decisions are your own responsibility.

Availability

We strive to keep SM Expense available 24/7, but we do not guarantee uninterrupted service. We may perform maintenance, updates, or experience issues beyond our control. We are not liable for any loss resulting from service downtime.

Section 03

Prohibited Use

You May NOT

Use SM Expense for any illegal purpose or to violate any laws. Upload malicious content, viruses, or harmful code. Attempt to gain unauthorized access to other users' accounts or our systems. Scrape, reverse-engineer, or copy any part of the application. Share your account credentials with others. Use the service to harass, abuse, or harm others. Misrepresent your identity or age.

Enforcement

We reserve the right to suspend or terminate accounts that violate these terms, without prior notice. We may also report illegal activity to relevant authorities.

Section 04

Subscriptions & Billing

Free Tier

SM Expense offers a free tier with basic features. No credit card is required to use the free tier.

Paid Plans

Paid subscription plans offer additional features as described on our pricing page. Prices are listed in USD and may be subject to applicable sales tax depending on your location.

Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You will be charged the same rate unless we notify you of a price change in advance.

Cancellation

You can cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until then.

Refunds

We offer a 30-day money-back guarantee for first-time subscribers. If you are not satisfied within 30 days of your first paid subscription, contact us for a full refund. Refunds for subsequent billing periods are handled on a case-by-case basis.

Payment Processing

All payments are processed securely by Stripe. We never see or store your full credit card number. By subscribing, you also agree to Stripe's terms of service.

Section 05

Intellectual Property

Our Property

SM Expense, its design, code, branding, and content are owned by SM Expense and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the application without our written permission.

Your Data

You retain full ownership of the data you input into SM Expense (expenses, budgets, receipts, etc.). We do not claim ownership of your data. We only access your data to provide the service as described in our Privacy Policy.

Section 06

Limitation of Liability

Disclaimer

SM Expense is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be error-free, secure, or uninterrupted.

Liability Cap

To the maximum extent permitted by law, SM Expense's total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

No Financial Liability

SM Expense is not responsible for any financial decisions you make based on data shown in the application. We are not liable for any inaccurate expense categorization by our AI features. Always verify important financial information independently.

Section 07

Dispute Resolution

Informal Resolution

Before filing any legal claim, you agree to contact us first and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the United States of America. Any disputes shall be resolved in the courts of the applicable jurisdiction.

Section 08

Changes & Termination

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification at least 30 days before the changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the new terms.

Termination by You

You can delete your account at any time. Upon deletion, your data will be permanently removed from our systems within 30 days.

Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in prohibited use, or if we discontinue the service. We will provide reasonable notice when possible.
